Our rights to knowledge, to learning, to access to culture and to freedom of experssion would be seriously undermined if the tools currently available to society were to be restricted.<\/p>\n<p style=\"text-align: left;\"><strong>2.<\/strong> That <strong>authors<\/strong> shall be able to manage royalties arising from their own work. Considering that royalty management bodies are private entities and, just like consultancy or cleaning services, they should be able to be used or not, according to the way we decide to live our lives, we ask that <strong>royalty management associations<\/strong> become what they really are:<\/p>\n<ul>\n<li>Private entities that ONLY AND EXCLUSIVELY manage the &#8220;accounts&#8221; of their members, that is, the exploitation rights of a certain percentage of artists. That free competition be permitted as with all private entities, and that under no circumstances should royalty management bodies be allowed to delve into the privacy and the pockets of citizens and even less to use public assets and land for their own private benefit. That authors and editors should not be represented by the same entity, as in the days of vertical unions, that all members have the right to vote. And, above all, that royalty management entities should only manage registered works, thus allowing the use of free licences. That in no case should private entities manage non-individualisable moneys, (such as the digital levy in Spain, if it continued to exist), given that it violates its own statues.<\/li>\n<\/ul>\n<p style=\"text-align: left;\"><strong>3. <\/strong>That <strong>author\/creators be paid<\/strong> equitably (15% of the budget for the activity they are involved in), whether or not they are members of a royalty management body. That, if they so wish, artists be paid mainly for their creations and not for the exploitation they generate. This will prevent the use of royalties for the precarization of the waged labour in the creative sector, that is, prevent the non-payment of fair wages in exchange for hypothetical earnings through royalties.<\/p>\n<p style=\"text-align: left;\"><strong>4.<\/strong> The immediate abolition of all <strong>&#8220;digital levys&#8221;<\/strong> that indiscriminately sanction everybody in the name of &#8220;compensation for artists&#8221; and attempt to penalize activities that are in no way criminal. Abolition of the concept of compensation for private copies, with full acceptance of the right to private copy as an intrinsic part of human memory since the invention of the Internet.<\/p>\n<p style=\"text-align: left;\"><strong>5.<\/strong> That artworks become part of the <strong>Public Domain<\/strong> within periods that are of benefit to creativity and society. To allow more than one generation to live from somebody&#8217;s work is a way of encouraging parasitism and creative stagnancy, and of deactivating reinvestment, In particular, considering that a measure designed to favour individuals ends up actually benefiting multinationals that distort original creations. We ask that works become part of the public domain within a reasonable period of time, according to the kind of work, with a maximum of 30 years. That all creative work that uses material obtained from the public domain is to have a &#8220;sharealike type&#8221; copyleft licence that makes it impossible to privatise the use of its results, which will revert to the commons. Likewise, all works created with public moneys, in as much as the commons is considered to be their &#8220;producer&#8221;, will be obliged to use this same type of licence. Obviously, the economic exploitation of the works in both of these cases would still be permitted.<\/p>\n<p style=\"text-align: left;\"><strong>6. <\/strong>That there be no requirement to seek an <strong>author&#8217;s permission<\/strong> for the reproduction, transformation or diffusion of artistic, scientific or technical works that have already been presented publicly, when the purpose is educational, teaching or scientific research in the public sphere, as long as the author&#8217;s name is included and all moral rights respected. That this use be subject to &#8220;share-alike&#8221; formulas in order to avoid undue appropriation. The defence of the right to private copy and fair use of works should be firm and absolute, given that copying is the very base of learning and culture. Author\/creators are indebted to shared culture and for this reason their contributions to Culture do not have to be subject to any form of compensation beyond their own commercial use of their work (sales, fees and royalties related to said sales or performances&#8230;).<\/p>\n<p style=\"text-align: left;\"><strong>7. <\/strong>Likewise, when the <strong>copyright<\/strong> for any kind of work is held by government institutions, such work should immediately become part of the public domain for any purpose whatsoever.<\/p>\n<p style=\"text-align: left;\"><strong>8.<\/strong> That the <strong>&#8220;right to quote&#8221;<\/strong> be defended in all cases as a vehicle for the democratic development of the information society, in all cases in which the material quoted has already been made public in advance, whether it is quoted for educational or scientific reasons, or for purely informational or creative purposes.<\/p>\n<p style=\"text-align: left;\"><strong>9.<\/strong> That the concept of <strong>&#8220;missed losses&#8221;<\/strong> should be eliminated from anything relating to cultural production, as should the mandatory nature of payment for public communication and payment for private copy.<\/p>\n<p style=\"text-align: left;\"><strong>10. <\/strong>Considering that the <strong>secrecy of communication<\/strong> is guaranteed by State Constitutions and International Human Rights Treaties, that the data traffic received or generated on the Internet should not be able to be manipulated, hindered, distorted, deflected, prioritised or delayed in accordance with the kind of content, protocol or application used, the source or destination of the communication or any other circumstances unrelated to its purpose (&#8220;Net Neutrality&#8221;) that is not based on public interest issues and without a court order. In all cases, any other limitation or restriction entails a curtailment of the right to freedom of expression (the right to send and receive information without any limitations other than those established by law). This is one of the foundations of democratic societies, recognised by all international bodies. We ask that this traffic be seen as the private communication that it is, and us such, that a court order be required if it is to be monitored, traced, archived or have its content studied in any way. It is up to judges, in accordance with the applicable legislation and by due process of law, to determine the cases in which there has been an offense and to establish the appropriate penalty in accordance with the Principle of Proportionality. These provisions are already in place in the Criminal Code.<\/p>\n<p style=\"text-align: left;\">______________________________________<\/p>\n<h2>\n<p style=\"text-align: left;\"><strong>Dec\u00e1logo de Medidas Necesarias para Preservar la Sociedad del Conocimiento <\/strong><\/p>\n<\/h2>\n<p style=\"text-align: left;\"><em>de eXgae con la contribuci\u00f3n de la Red<\/em><\/p>\n<p style=\"text-align: left;\"><em>A la hora de elaborar sus pol\u00edticas legislativas, los Estados deber\u00edan recordar que los derechos de autor surgieron como un incentivos a la creation y como tales son un medio, y no, como pretende la industria del entretenimiento, la meta.<\/em><\/p>\n<p style=\"text-align: left;\">Amigos del Desarrollo en la OMPI<\/p>\n<p style=\"text-align: left;\"><strong>1.<\/strong> Considerar cualquier recorte a las <strong>redes de intercambio<\/strong> de archivos (redes P2P) o a otros protocolos como un acto de oscurantismo y un atentado contra los derechos democr\u00e1ticos fundamentales garantizados por nuestra constituci\u00f3n y por innumerables tratados internacionales. Nuestros derechos al conocimiento, al aprendizaje, al acceso a la cultura y a la libertad de expresi\u00f3n se ver\u00edan gravemente socavados si se limitaran las herramientas de las que dispone actualmente la sociedad.<\/p>\n<p style=\"text-align: left;\"><strong>2.<\/strong> Los <strong>derechos de autor<\/strong> deben poder ser gestionados libremente por el propio autor. Considerando que las entidades de gesti\u00f3n son entidades privadas y, al igual que un servicio de consultor\u00eda o de limpieza, se deber\u00eda poder utilizar o no seg\u00fan nuestras opciones de vida, pedimos que las entidades de gesti\u00f3n pasen a ser lo que son: entidades privadas que gestionan \u00daNICA Y EXCLUSIVAMENTE las &#8220;cuentas&#8221; de sus socios, es decir, los derechos de explotaci\u00f3n de una parte de los artistas. Que, como ocurre con toda entidad privada, se permita la libre competencia y que bajo ning\u00fan concepto se consienta que entidades privadas hurguen en la privacidad y en los bolsillos de los ciudadanos y, menos a\u00fan, que se utilicen bienes y suelo p\u00fablico para sus beneficios privados. Que autores y editores no sean representados por la misma entidad como en los tiempos del sindicato vertical, que todos los socios puedan votar y, sobre todo, que las entidades de gesti\u00f3n gestionen \u00fanicamente las creaciones registradas, permitiendo as\u00ed el uso de licencias libres. Que en ning\u00fan caso entidades privadas gestionen dinero &#8220;no individualizable&#8221;, tipo canon (gesti\u00f3n colectiva obligatoria , si siguiera subsistiendo), ya que vulnera sus propios estatutos.<\/p>\n<p style=\"text-align: left;\"><strong>3.<\/strong> Que los <strong>creadores sean remunerados<\/strong> de forma equitativa (un 15% del presupuesto de la actividad en la que est\u00e1n involucrados), sean o no socios de entidades de gesti\u00f3n. Que los artistas cobren, si as\u00ed lo desean, principalmente por su creaci\u00f3n y no por la explotaci\u00f3n que \u00e9sta genera. Esto evitar\u00e1 que se utilicen los derechos de autor para la precarizaci\u00f3n del trabajo asalariado del sector creativo, es decir, que evitar\u00e1 que no se paguen salarios justos a cambio de una hipot\u00e9tica ganancia v\u00eda derechos de autor.<\/p>\n<p style=\"text-align: left;\"><strong>4.<\/strong> Abolici\u00f3n inmediata del <strong>canon digital<\/strong>, extra\u00f1o diezmo que sanciona indiscriminadamente a la ciudadan\u00eda en nombre de la &#8220;compensaci\u00f3n a la creaci\u00f3n&#8221;, intentando penalizar una conducta que no es en ning\u00fan caso delictiva. Abolici\u00f3n del concepto de compensaci\u00f3n por copia privada, asumiendo plenamente el derecho a la copia privada como intr\u00ednseco a la propia memoria humana desde la invenci\u00f3n de Internet.<\/p>\n<p style=\"text-align: left;\"><strong>5. <\/strong>Que una obra pase a ser de <strong>dominio p\u00fablico<\/strong> en unos plazos beneficiosos para la creaci\u00f3n y la sociedad. Permitir que m\u00e1s de una generaci\u00f3n viva del trabajo de alguien es un forma de fomentar el parasitismo y el estancamiento creativo que desactiva la reinversi\u00f3n, especialmente considerando que una medida pensada para favorecer a las personas en realidad beneficia principalmente a grandes multinacionales que desvirt\u00faan la creaci\u00f3n primigenia. Pedimos el paso al dominio p\u00fablico en un periodo de tiempo razonable, dependiendo del tipo de creaci\u00f3n, con un m\u00e1ximo de 30 a\u00f1os. Toda creaci\u00f3n que utilice material obtenido de obras de dominio p\u00fablico tendr\u00e1 que tener una licencia copyleft de tipo SA, es decir, no podr\u00e1 privatizarse el uso de sus resultados, que deber\u00e1n revertir en el procom\u00fan. De la misma forma, toda obra producida con dinero p\u00fablico, al considerarse que el procom\u00fan es &#8220;el productor&#8221;, tendr\u00e1 que tener este mismo tipo de licencia. Obviamente, en ambos casos no se impide su explotaci\u00f3n econ\u00f3mica.<\/p>\n<p style=\"text-align: left;\"><strong>6.<\/strong> No deben necesitar <strong>autorizaci\u00f3n del autor<\/strong> los actos de reproducci\u00f3n, transformaci\u00f3n o difusi\u00f3n de obras art\u00edsticas, cient\u00edficas o t\u00e9cnicas ya divulgados cuando se realicen con fines privados o, en el \u00e1mbito p\u00fablico, con fines informativos, docentes, educativos o de investigaci\u00f3n cient\u00edfica, siempre que se incluya el nombre del autor y el resto de derechos morales. La transformaci\u00f3n deber\u00eda realizarse utilizando la cesi\u00f3n en cadena para evitar una apropiaci\u00f3n indebida. La defensa del derecho a copia privada y del &#8220;fair use&#8221; de las obras debe ser firme y absoluta, siendo la copia la base misma del aprendizaje y de la cultura. Los autores son deudores y parte de la cultura com\u00fan y por esta raz\u00f3n su aportaci\u00f3n a la Cultura no tiene que estar sujeta a compensaci\u00f3n alguna m\u00e1s all\u00e1 del uso comercial que ellos mismo dan a su creaci\u00f3n (ventas, cach\u00e9 y derechos de autor relacionados con dichas ventas o actuaciones&#8230;).<\/p>\n<p style=\"text-align: left;\"><strong>7.<\/strong> Asimismo los <strong>derechos de autor<\/strong> sobre cualquier tipo de obra de los que las instituciones p\u00fablicas sean derechohabientes ser\u00e1n a todos los efectos de dominio p\u00fablico inmediato.<\/p>\n<p style=\"text-align: left;\"><strong>8.<\/strong> Defender el <strong>&#8220;derecho a cita&#8221;<\/strong> como veh\u00edculo de crecimiento democr\u00e1tico de la sociedad de la informaci\u00f3n en todos los casos en los que se cita algo que ya hab\u00eda sido hecho p\u00fablico previamente, tanto si se cita por razones pedag\u00f3gicas o cient\u00edficas,  como por razones puramente informativas o creativas.<\/p>\n<p style=\"text-align: left;\"><strong>9. <\/strong>Eliminar el concepto de<strong> &#8220;lucro cesante&#8221; <\/strong>en todo lo que concierne a la producci\u00f3n cultural. Eliminar la obligatoriedad del cobro de la compensaci\u00f3n por comunicaci\u00f3n p\u00fablica y por compensaci\u00f3n por copia privada. Es inconstitucional.<\/p>\n<p style=\"text-align: left;\"><strong>10.<\/strong> El <strong>secreto de las comunicaciones<\/strong> garantizado por las Constituciones de los Estados y por los Tratados Internacionales sobre Derechos Humanos implica que el tr\u00e1fico de datos recibidos o generados en Internet no puede ser manipulado, tergiversado, impedido, desviado, priorizado o retrasado en funci\u00f3n del tipo de contenido,  del protocolo o aplicaci\u00f3n utilizados, del origen o destino de la comunicaci\u00f3n ni de cualquier otra consideraci\u00f3n ajena a la de su propia voluntad (&#8220;Neutralidad en la Red&#8221; \/ &#8220;Net Neutrality&#8221;) no fundamentada en cuestiones de inter\u00e9s p\u00fablico que la justifiquen y salvo mandato judicial. En todo caso, cualquier limitaci\u00f3n o restricci\u00f3n no basada en estas cuestiones supone una restricci\u00f3n del derecho a libertad de expresi\u00f3n (el derecho a enviar y recibir informaciones sin mas limitaciones que las establecidas por la ley), fundamento de las sociedades democr\u00e1ticas y reconocido por todos los instrumentos internacionales. Ese tr\u00e1fico se tratar\u00e1 como la comunicaci\u00f3n privada que es y solo podr\u00e1 ser espiado, trazado,  archivado o analizado en su contenido exclusivamente bajo mandato judicial.? Corresponde a los jueces determinar, de acuerdo con la legislaci\u00f3n aplicable y mediante el proceso debido, en qu\u00e9 casos se ha producido una infracci\u00f3n y establecer la correspondiente sanci\u00f3n de acuerdo con el principio de proporcionalidad.
